Answer: Introduction: In August 2007, the High court of Australia gave the hearing in favour of the RTA stating that a duty of care imposes a responsibility to exercise care and not the duty of RTA to prevent any dangerous conduct by the people. This article will throw light on the different argument posed by the defendant as well as the RTA and the Council. It will focus on how the various reasoning posed by the High court was insufficient in rendering justice to Philip Dederer, the injured party in the case. The Case In that fateful day of December in the year 1998, Mr. Philip Dederer aged 14 jumped off Forester Tuncurry Bridge into Wallamba River that led to a serious spinal injury resulting in partial paralysis. He dived off into the bridge and hit his head on the sandbar which caused the injury. This place was a popular tourist attraction attracting people to dive into the estuary below. Jumping off the bridge into the water had been a regular phenomenon and numerous young people did so with no injuries being reported. Mr Philip was a regular visitor of the place since his childhood to spend holidays there. He had been a close observer of young and adults diving off the bridge. The previous day, Dederer jumped twice from the bridge but his feet did not touch the bottom. Since he had seen people diving into the water before he decided to try doing that himself on the day the accident took place. These instances may have excited him to try diving himself. When asked at the court on why he did not pay any heed to the signs of warning, the boy said that he never attached any thought of danger to No diving sign. Although there were various pictorial signs of no diving displayed there, people didnt pay any heed to the images. The RTA then replaced the pictures with signs of NO DIVING and NO CLIMBING, but they failed to make an impact through this initiative as well. The estuary was in the area of beach where tidal activity was at a very high level. Depth of the water was unpredictable and it dropped from time to time at the edge of the sandbar. The water flowing from under the bridge was indeed very deep making it extremely risky for people to dive in high tides. It is surprising that in spite of all these warning signs there were still people who would jump into the estuary from the bridge without any serious action taken by the RTA or the Police. Mr. Philip Dederer filed a case of negligence against the RTA Great Lakes Shire Council. Decision of Trial Court In the verdict of Judge Dunford of the Supreme Court found the RTA and the Council negligent. According to him it was the duty of the RTA and the Council to make the general visitors aware of the probable danger of diving off the bridge, knowing the uncertainty of the depth of the water and the sandbar. The failure of people to follow the warning must have awakened the RTA and Council about the danger surrounding the bridge. They should have worked out various other options or found some other initiatives to make the bridge safer. The bridge had horizontal railings which made it easier for the visitors to jump off. The Judge also said that the RTA violated its duty in taking necessary action such as altering the terminologies in order to draw attention to its probable danger such as, danger, shifting sands, variable depths etc; steps should have been taken to also change the railings from horizontal to vertical in order to prevent diving. They were also unsuccessful in changing the top handrail from flat to something more difficult to stand upon and dive or jump. The Judge also assigned 25% blame on Mr. Philip for being negligent and not considering safety aspects before diving into the water. It was also observed that RTA had the total control of the bridge since they had a greater access to funds which could have enabled them to make modifications to the bridge for the safety of the visitors but they did not take any initiative. Therefore he apportioned 80% of the blame to RTA and 20% to the Council. The verdict obviously made the RTA and Council upset and they appealed against the findings of the Judge about their negligence and well as the blame apportionment. Court of Appeal The majority of the Court of Appeal, Tobias JJA and Handley agreed that the Council as well had a considerable de facto control over the bridge which made them responsible to care for the safety of people, including the plaintiff. It was also said that the boy was big enough to understand his own ability to make that dive or not as well, even in the absence of the sign boards he should have gauged the possibility of danger in jumping from the bridge. The term obvious risk in Division 4 of theCivil Liability Act2002 released the Council from legal responsibility of the boys physical injury as there was an obvious risk of diving from there without any doubt. Over a long period of time the common law has stated that defendants are not liable for risks which are common or obvious argued in cases such as Philips v Daly (1988) 15 NSWLR 65. However even though there is a obvious risk factor it does not negate the duty of care towards people. The Court of Appeal found RTA in the violation of its common law duty due to the plaintiffs safety. They failed to meet the standard of safety that was required under this circumstance. This is the first Court of Appeal case where the defendant had banked on the obvious risk provision in the Civil Liability Act, 2002 and won. Liability of the Road Traffic Authority The evidence stated that the bridge was an allurement to the visitors there especially the youth who knew not much about their own safety aspects given their age factor. The RTA could not have denied witnessing young children diving off that bridge several times in the past. Therefore in spite of probable threat to safety no initiatives were taken by the RTA. Furthermore, modifying the sign boards to suggest danger may have been inexpensive and could have avoided this accident which the RTA failed to do either. The Court of Appeal held the plaintiff 50% at fault for not recognising his safety issues. High Court Verdict The high court stated that the RTA did not owe completely to the risk of injury. The warning signs should have caused people to exercise some level of caution which they failed to do. His Honour also said that the failure of warning signs and the necessary negligence on part of the RTA could not be attributed to the RTAs care of duty. Just because the people failed to heed to the warning does not mean that RTA was at fault. Gummow. J found that the Court of Appeals and the Judge of the Supreme Court, His Honour Dunford Js findings were flawed. They failed to see the limited scope of RTA to determine the actual risk of injury in the plaintiffs case. The RTA did not control the plaintiffs voluntary decision to dive in nor the natural variables such as depth of the water. Plaintiffs Argument Dederer did notice the No diving signboard however did not consider jumping off such a small height, fatal. He did not recognise the impending danger following his jump. Following are the reasons cited by Dederer in his defence against the RTA and the Council. Design of the bridge: It was quite evident that the bridge was used by many tourists to dive down or jump. The construction of the bridge made it easier for people to jump from there. The railings were horizontal and the top most railing was flat which made it easier to find grip to stand over it. This arrangement obviously allured people into diving. The RTA should have considered increasing the height of the bridge and changed the railing to vertical position to prevent diving. Lack of initiative: Additionally the age group of people who jumped was mostly young which the RTA is aware of and it did not cause them to take any initiative for the safety aspect of those visiting there. Change of warning signs: When the RTA observed that the pictures for warning were not paid attention to, they should have thought of changing the warning signs. The No diving sign did not suggest danger. It could have meant a statutory obligation without actually expressing the idea of a probable danger. RTA should have taken steps to put sign boards that said danger, variable depths of water etc to make the people aware. Councils Approach: The council, recognising the inadequacy of the signage approached the RTA to take steps but it proved futile. This clearly showed the negligence on part of the RTA. Had they taken precaution in dealing with this issue Dederers accident could be prevented. Risk- Management Analysis: There werent any risk management analysis done by the RTA to make the place safe for the visitors. The process of Risk management analysis can be explained through the following diagram. The procedure involves thorough communication and consultation followed by monitoring and reviewing the effectiveness of the initiatives taken. The RTA failed to perform the basic requirements to make the place safe. Conclusion The decision of the majority of the High Court Judges in the Dederer case that a minor should take full responsibility of the accident shows a complete disregard in accidents and tragic incidents involving children. According to them a child is supposed to understand the impending danger and act accordingly, which is an uncommon expectation from a child. The very fact that the Law and Order shows leniency to individuals under the age of 18 and considers them as amateurs should be proof enough that children do not have the ability to understand or make sense of what is right and wrong for them, especially where their hormones have the better of them. The High court failed to see what is clearly evident to others that what the RTA should have taken responsibility for is rendered liable to the child. Cases such as Vary V Wyong Shire Council (2005), Cole v South Tweed Heads Rugby League Football Club Ltd (2004) shows the apathy of the High Court towards general public. Cotton Industry THE COTTON INDUSTRY IN AUSTRALIA 1. Introduction Cotton is one of the oldest fibres used by human beings. Archaeologists have found cotton 5000 years old. Alexander the Great, around 300 BC, brought cotton goods into Europe but only the rich could afford it. The cotton plant grew wild in East Africa. Cotton belongs to the Hibiscus family. Our commercial varieties of cotton were developed from perennial shrubs in Central America. (Source A) 2. History of the cotton industry. Governor Phillip brought cottonseeds to Australia on the First Fleet in 1788. However, substantial production really only occurred in the 1860's with the American Civil war creating a shortage for the English spinners. Large areas of dryland cotton were planted in Queensland to meet the demand. A similar burst in production occurred in the 1930's when the American cotton crop had boll weevil problems. By 1934 Australia's production had risen to 17,000 bales, but 20 years later our cotton industry was almost non existent. Interest in cotton revived in the 1960's when the construction of major dams in northern NSW and southern Queensland enabled irrigated cotton production. Another boost to the industry was the arrival in Wee Waa of two American cotton growers who showed how to grow the crop. Irrigated and dryland planting have continued to expand since then. How Velociraptor Was Discovered Of all the dinosaurs that have been discovered over the last 200 years, Velociraptor comes closest to the romantic ideal of rugged paleontologists trekking across dangerous, windswept terrain in search of ancient fossils. Ironically, though, this dinosaur was nowhere near as smart and vicious as it has subsequently been depicted in movies, the main culprit being Jurassic Parks pack-hunting, quick-thinking, doorknob-turning Velociraptors (which were actually played by individuals of the closely related raptor genus Deinonychus, and even then not all that accurately). The Velociraptors of the Gobi Desert In the early 1920s, Mongolia (located in central Asia) was one of the most remote places on the face of the earth, inaccessible by train, plane, or pretty much anything else except a well-stocked caravan of well-oiled automobiles and sturdy horses. That is exactly what New Yorks American Museum of Natural History dispatched to outer Mongolia, by way of western China, in a series of fossil-hunting expeditions led by the famous paleontologist Roy Chapman Andrews. Although Andrews personally discovered and named many Mongolian dinosaurs in the early 1920s- including Oviraptor and Protoceratops- the honor of unearthing Velociraptor went to one of his associates, Peter Kaisen, who stumbled upon a crushed skull and toe claw at a dig site in the Gobi Desert. Unfortunately for Kaisen, the honor of naming Velociraptor didnt go to him, or even to Andrews, but to Henry Fairfield Osborn, the president of the American Museum of Natural History (who, after all, wrote all the checks). Osborn referred to this dinosaur as Ovoraptor in a popular magazine article; fortunately for generations of schoolkids (can you imagine having to distinguish between Ovoraptor and Oviraptor?) he settled on Velociraptor mongoliensis (speedy thief from Mongolia) for his scientific paper. Velociraptor Behind the Iron Curtain It was difficult enough to send an American expedition to the Gobi Desert in the early 1920s; that became a political impossibility only a few years later, as the Mongolian government was toppled by a Communist revolution and the Soviet Union exerted its hegemony over Mongolian science. (The Peoples Republic of China didnt come into existence until 1949, giving the USSR a crucial head start in a Mongolian nation that, today, is dominated by China rather than Russia.) The upshot was that, for over 50 years, the American Museum of Natural History was excluded from any further Velociraptor-hunting expeditions. After World War II, Mongolian scientists, aided by colleagues from the USSR and Poland, returned repeatedly to the Flaming Cliffs fossil site where the original Velociraptor specimens had been unearthed. The most famous discovery- of a near-complete Velociraptor caught in the act of grappling with an equally well-preserved Protoceratops- was announced in 1971. In the late 1980s, following the crumbling of the Soviet Union and its satellites, western scientists were again able to travel in Mongolia. This was when a joint Chinese and Canadian team discovered Velociraptor specimens in northern China, and a joint Mongolian and American team unearthed additional Velociraptors at the Flaming Cliffs site. (One of the specimens discovered on this latter expedition was informally named Ichabodcraniosaurus, after Nathaniel Hawthornes headless horseman because it was missing its skull.) Later, in 2007, paleontologists discovered a Velociraptor forearm bearing the unmistakable imprint of quills- the first definite proof that (as had long been suspected) Velociraptor sported feathers rather than reptilian scales. The Feathered Theropods of Central Asia As famous as it is, Velociraptor was far from the only feathered, meat-eating dinosaur of late Cretaceous central Asia. The ground was thick with dino-birds closely related to the North American Troodon, including Saurornithoides, Linhevenator, Byronosaurus, and the wonderfully named Zanabazar; feathered dinosaurs closely related to Oviraptor, including Heyuannia, Citipati, Conchoraptor, and the (also) wonderfully named Khaan; and a vast assortment of associated raptors. Most of these dinosaurs were discovered in the late 20th century, under the auspices of a talented generation of Chinese paleontologists. What was it about the windswept Mongolian plains that favored this brand of dinosaur diversity? Clearly, conditions in late Cretaceous central Asia  favored small, skittery animals that could nimbly pursue smaller prey or speedily escape from the clutches of slightly bigger dino-birds. In fact, the profusion of central Asian feathered dinosaurs points to the most likely explanation for the evolution of flight: originally evolved for the purposes of insulation and display, feathers gave dinosaurs a certain amount of lift while they were running, and were thus increasingly favored by natural selection until one lucky reptile achieved actual lift-off!

Middlebrooks’ argument during the course of his trial was that he only acted the way he had because Brewington, being a larger boy and angrier than Middlebrooks, frightened him. It also has an entablature with a cornice and the architrave. The two middle columns are placed a bit  to the sides to emphasize the door. This part looks a bit like a Grecian temple and that makes it look authorative. Another example of a building made in the Renaissance is The Tempietto del San Pietro. It is a cylinder-shaped little church in Rome. The word â€Å"tempietto† means â€Å"small Temple† as it is one. The Tempietto is built at the court of the San pietro in Montorio church. It was built by Donato Bramante in 1502. The Spanish king Ferdinand ordered Bramante to build a church to remember the crucifixion of Petrus, one of the first apostles and the first pope. The little temple would be built on the spot where Petrus was crucified. This is why the building is especially important in Rome. As you can see it looks very Greek again because of the columns with doric capitals. It also has a dome but it especially looks Greek because of the symmetry of the temple. The building expresses the balanced proportions of Renaissance architecture. The columns, the frieze and the decorative features all show the classical influence. At the end of the 17th century, Baroque rose up and started to replace the Renaissance. This change was due to religious reasons. In the 1500s the Roman Catholic Church was under much pressure to reform. In this period, Protestantism was rising, especially in northern Europe. Protestantism was highly critical of the Roman Catholic Church and its abuses of its powerful position. Baroque can be seen as a cultural public relations movement started by the Roman Catholic Church to win back the support of the people. Protestantism is characterized by sober architecture. The roman-Catholics decided to go the opposite direction and promote architecture which was over the top, dramatic and extraordinary, to try and get the public back to re-interest in the Roman Catholic Church again. Baroque is an architectural style, which evolved in the 16th century in Italy. During the 17th century, the style spread through Europe and Latin America. Baroque architecture is the opposite of Renaissance architecture. Renaissance architecture was very calm and balanced, symmetrical and harmonious while the baroque architecture was very extravagant and asymmetrical. Baroque style is all about drama, energy and rhythm. The  grandiose buildings, sculptures and paintings were meant to inspire religious awe and excitement in the people. The Baroque architecture draws your attention. Baroque style is typical for breaking the limits for classic buildings and going in an extreme form. Most baroque buildings have bent asymmetrical shapes. Baroque architecture buildings are supposed to amaze people. It is supposed to look fantastic and over the top. Some people might think it is kitsch. This is a picture of a kaisersal residence, which was used from 1719 to 1944. Johann Balthazar Neumann was the architect who designed this baroque style house for the Prince Bishops of Wuerzburg. In this room, the Bishop received important people. The over the top theme of baroque is shown in this room by the amount of decoration. It is really overwhelming because of all the gold and the decorations. You can see that this room was designed to receive important people as it would impress them. You can’t recognize any Renaissance architecture features in this room anymore. You can’t see any Ancient Greek or Roman architectural features. This is another example of Baroque architecture. It is the Berlin Cathedral or Berliner Dom in Berlin, Germany. It is also called the Lutheran Cathedral. The people who went to Berlin might recognize it. Again, you can see that it is very extravagant and over the top. It has many details and decorative features such as all the sculptures. This building has some Renaissance features though such as the pilasters and the pediments and off course the domes. The baroque spread through Europe but didn’t really spread in this form to northern Europe because Protestantism was too strong there. In Holland, which was also very protestant, the Baroque style developed in its own way. It had such a distinctive style that it got a different name: Dutch Classicism or Hollands Classicisme. It glorified the Dutch Republic of the 17th century, democracy and the new found wealth from colonialism.
